From NOA to signing the contract: how many days you get
Last updated: · 4 min read
- The office issues the NOA within 3 working days of approval and before bid validity ends (rule 48(5)(ক), Schedule-2).
- In national tenders you give the performance security within 7, 10 or 14 working days of the NOA date, depending on the office's official estimate: up to Tk 5 crore, 5 to 25 crore, above 25 crore.
- You sign the contract within 14, 21 or 28 days on the same estimate bands.
- If you are late, tender security can be forfeited and the work can go to the next lowest bidder.
When the NOA reaches you there is time to be pleased, but a clock also starts. PPR 2025 says what must be done in how many days.
This is not legal advice. The dates are written in your NOA and contract draft, and those bind you. Sources at the end.
How the NOA comes
The office picks the lowest responsive bid and sends the evaluation report for approval. After approval, within 3 working days under Schedule-2, and before your bid validity ends, the office issues the NOA (rule 48(5)(ক)). One condition: if a complaint or appeal on that tender is pending, the NOA cannot be issued (rule 76(2)).
The NOA states: the information on accepting the bid, the contract price, the amount and form of the performance security, the time limit to give it, and the date and time of signing (rule 123(2)).
Within 24 hours of issuing the NOA, the award information must be placed for at least 28 days on the office's notice board, on its website (if it has one) and on BPPA's website, so the other bidders know (rule 49(1), Schedule-2).
Two clocks: security and signing
Under Schedule-2, rules 123(5) and 123(9), in national tenders the times from the NOA date are as below. The bands are keyed to the office's official estimated cost, not to the contract price:
| Official estimate | Security | Signing |
|---|---|---|
| up to Tk 5 crore | within 7 working days | within 14 days |
| above 5 crore, up to 25 crore | within 10 working days | within 21 days |
| above 25 crore | within 14 working days | within 28 days |
| International tender | within 28 working days | within 42 days |
Security first, then signing. The office can write to the bank to verify the security, and once it checks out, the contract is signed (rules 123(8) and (9)). For the amount and validity of the security, see the security post.
If you are late
- Not giving security or not signing: the office can proceed with the next lowest bidder (rule 123(11)). Your tender security can be forfeited (rule 34(খ) and (গ)).
- Security fails the bank check: tender security is forfeited, and action under section 64 of the Act is possible (rule 123(10)).
If the NOA is wrong, or you did not get the work
After the NOA is issued you can no longer file an administrative complaint with the office. Under rule 73(14) there is one exception: if you think the NOA was issued defectively or unlawfully, you appeal directly to the Review Panel. See complaints and appeals.
If you did not get the work, you can ask the office why. It tells you only your bid's relative position and shortcomings, and gives no information about other bidders (rule 49(4)).
What to do
- Write the dates down the day the NOA arrives: the last day for security and the last day for signing. Finish a day or two early.
- Talk to your bank in advance. A bank guarantee or pay order for the performance security takes time to arrange.
- Read the draft contract. If something is stuck, write to the office before time runs out.
- Once signed, the contract details become public. For contracts above Tk 10 lakh they go up on BPPA's website within 3 days of signing for at least 1 month (rule 49(2) and (3), Schedule-2).
- See who got what work, and at what rates, on who got the work and rates. Find new work on all tenders. Plans on pricing. Earlier plain guide: NOA.
